TERMS AND CONDITIONS

Introduction
Effective Date: August 17th, 2025

Welcome to Palmetto Auto Club LLC ("PAC," "we," "our," or "us"). These Terms & Conditions (“Terms”) govern your use of this website and membership services. By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

Scope and Eligibility

• The PAC website and content are for active paying members only (Enthusiast, Track, or VIP) and limited non-paying “Legacy Supporters” as designated by the Club.
• You must be at least 18 years old.
• PAC reserves the right to suspend or terminate access for any violation of these Terms or community guidelines.

Membership & Payments

• Memberships (Enthusiast, Track, VIP) are available at the pricing and terms published on the Membership page.
• All memberships renew automatically on an annual basis unless canceled before the renewal billing date.
• Membership upgrades or downgrades can be made via your Stripe portal. Prorated billing will be handled through the platform.
• Membership fees are non-refundable after a 7-day grace period, unless otherwise required by law.
• We reserve the right to change pricing or membership benefits; changes apply on renewal.

Digital Products & Onboarding

• Upon checkout, members are redirected to a Welcome Page with a Discord invite and onboarding information (e.g., how to access member roles, CRM, perks).
• If applicable, members may be sent a digital membership card (Apple Wallet / Google Wallet format) via email. The Club may automate this process via a third-party provider.
• Use of digital membership cards is governed by their provider’s terms in addition to these Terms.

Intellectual Property

• All website content, trademarks, logos, images, and materials (“IP”) are owned by PAC or its licensors. You may access and view content for personal use only.
• By uploading content (e.g., photos or videos in our gallery or Discord server), you grant PAC a worldwide, royalty-free, non-exclusive license to use, display, and adapt such content for promotional purposes. You represent that you own or have permission to share the content.

Community Conduct
Members must adhere to:

• Respectful behavior at all events and online.
• Safe, lawful driving—reckless or unsafe actions may result in revocation of membership without refund.
• Compliance with site or venue rules.

This includes passengers, guests, and dependents under your membership.


Liability & Release

• Events hosted by PAC are recreational in nature. Participation is at your own risk. PAC is not responsible for personal injury, vehicle damage, or loss of personal property.
• All participants must sign a liability waiver before attendance. No liability shall attach to PAC for claims arising from participation in events.
• PAC’s total liability under these Terms, whether in contract or tort, is capped at the total membership fees paid during the preceding 12 months.

Disclaimers & No Warranties
The website and services are provided “as-is” and “as available,” without warranties of any kind. PAC disclaims all warranties (express or implied), including fitness for a particular purpose and merchantability.​

Dispute Resolution

• If a dispute arises, first attempt informal resolution by contacting us.
• If unresolved, the dispute will go to binding arbitration under the rules of the American Arbitration Association.
• Each party bears its own costs. Arbitration judgment may be entered in court where required by law.

Modification to Terms
We may amend these Terms at any time. Material changes will be communicated via website banner or email. Continued membership or use after notice constitutes agreement to the updated Terms.​

Governing Law & Severability
These Terms are governed by the laws of South Carolina. If a provision is deemed invalid, the remainder stays in effect. Failure by PAC to enforce rights does not constitute a waiver.
